Market Consultation 1 for hydrogen - Code of Conduct governing access to the hydrogen transmission network
Legal and Regulatory Context
In accordance with Article 15 of the Hydrogen Act of 11 July 2023, the Commission for Electricity and Gas Regulation (CREG) is required to adopt a Code of Conduct governing access to the hydrogen transmission network, including provisions on standard contractual arrangements.
As provided by the legislation, the hydrogen network operator must submit a draft of the Code of Conduct to the CREG after consulting stakeholders and users of the hydrogen transmission network.
Objectives of the Code of Conduct
The Code of Conduct is intended to ensure, among other things, that:
- Access to the hydrogen transmission network and to the associated transport services is granted to all users under transparent and non‑discriminatory conditions, based on tariffs approved in accordance with Article 16 of the Hydrogen Act;
- The conditions for access to the hydrogen transmission network support effective competition and facilitate efficient cross‑border hydrogen trade;
- Any refusal of access to the hydrogen transmission network by the network operator is strictly based on objective technical criteria related to network capacity and operational constraints.
Public Consultation
Within this regulatory framework, Fluxys hydrogen is launching a market consultation on the draft of the Code of Conduct for hydrogen transport.
The purpose of this consultation is to gather feedback from market participants and stakeholders on the proposed draft of the Code of Conduct.
Documents Subject to Consultation
The consultation begins on 10 June 2026 and ends on 01 July 2026.

Participants are invited to submit their written comments by 01 July 2026 to the following email address: marketing.hydrogen@fluxys.com.
